Other Signs such as Names and Company Names

In addition to trademarks and domain names, there is a host of other signs which are closely associated with your person, your company or your range of products/services. They include your family name, the name of your company (business name) but also symbols or abbreviations such as company phrases or trade names, i.e. signs by which your company's products are known on the market. This could also include particular signs within agriculture, such as the so-called AOP (Appellation d’Origine Protégée). We advise on all aspects of sign law, from the evaluation process through to the enforcement of your rights to such signs.

We assist in developing an appropriate strategy for your signs which takes into account the specific nature of the individual types of sign.

Monitoring

The targeted monitoring of your signs (both in Switzerland and abroad) allows us to advise in good time of any possible conflicts in relation to signs. If necessary, we initiate suitable legal measures.

Deeds of Assignment, Licensing Agreements and Settlement Agreements

Certain signs can be assigned in Switzerland and abroad. We assist in preparing and acquiring the necessary agreements and other documents whilst also ensuring that assignments are recorded in the relevant registers, if register rights exist.

If a sign is (also) to be used by third parties or if you wish to use signs belonging to a third party, we draw up the necessary licensing agreements.

Sign-related conflicts can often be resolved by reaching a settlement or by so-called delimitation agreements and we assist in negotiating these types of agreement.

Legal Disputes

If third parties infringe signs or associated agreements or if you are alleged to have committed a corresponding infringement, we will litigate on your behalf before the public ordinary courts and at any arbitration tribunals.
